Intellectual Property Policy

As required by the Digital Millennium Copyright Act of 1998 ("DMCA") U.S. Copyright Office Web Site, summary at:

http://web.archive.org/web/20020207202024/http://lcweb.loc.gov/copyright/legislation/dmca.pdf, or the full text of this statute: http://lcWeb.loc.gov/copyright/), Children's Educational Network will attempt to respond expeditiously to all claims of potential copyright infringement regarding websites owned or hosted by Children's Educational Network.

It is our policy to respond to notices of alleged infringement that comply with the DMCA in an appropriate manner under such Act and other applicable intellectual property laws, including the removal or disabling of access to material claimed to be the subject of infringing activity.

If you believe a website hosted by Children's Educational Network infringes a copyright, the DMCA requires that we obtain the information below in writing in the form of a "Notice of Copyright Infringement" ("Notice"). This means that we will respond only to Notices we receive in writing. Children's Educational Network will not accept nor respond to verbal, telephonic, or other Notices that are not compliant with the DMCA's requirements.

A DMCA notice shall include the following:

A physical signature of the copyright owner or authorized agent; [In order to protect content owners, users and ourselves from fraudulent claims of infringement and unwarranted removal of mater or link disablement based on insufficient Notices, it is our current policy to require a physical signature on all Notices. Under the DMCA, an "electronic signature" may also be acceptable. The law, however, does not specify what constitutes a suitable "electronic signature" and the current technological limitations in authenticating and verifying email communications creates a great risk of fraud. If and when Children's Educational Network is able to consistently and securely authenticate, verify and accept electronic communications, Children's Educational Network may amend this policy and allow acceptance of email Notices. However, at this time Children's Educational Network cannot and will not be able to respond to any Notices delivered by email, facsimile, or other method electronic transmission, of claimed copyright infringement. You must send any Notices to us by U.S. MAIL, EXPRESS DELIVERY, COURIER or other means of physical delivery.]

Identification of the copyrighted work(s) claimed to have been infringed;

Identification of the material that is claimed to be infringing or to be the subject of the infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material. Specifically, the information we need to identify and disable a link to allegedly infringing material may be obtained by right clicking with your mouse on a hit, selecting [Copy URL] and pasting the copy into your Notice. Without this information, it may be impossible for Children's Educational Network to identify and disable the material, specific link or reference at issue;

Your street or mailing address, telephone number, and, if available, email address where we may contact you;

A statement that the copyright owner or its authorized agent has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
A statement by you, made under penalty of perjury, that all the information in your Notice is accurate and that you are the copyright owner, or authorized to act on behalf of an owner of any exclusive right that is allegedly infringed by the materials referenced in your Notice. The Notice must be signed with the physical signature of the copyright owner or of a person authorized to act on behalf of an owner of any exclusive right that is allegedly infringed by the materials referenced in your Notice; and

Pursuant to 17 United States Code 512(c)(2) (DMCA) the following individual is Children's Educational Network's Designated Copyright Agent for notice of alleged copyright infringement:
